市町村による包括的土地利用方策として、国土利用計画法に基づく市町村計画や都市計画マスタープランと市町村が制定する独自条例を組み合わせる方法の有効性が指摘されているが、線引き都市では、都計法に基づく開発許可制度をベースとして、都計法規定外の建設物および工作物(太陽光発電施設等)の立地制限は対象外となることや、逆に立地規制により集落拠点地域の整備開発が制約される立地規制等課題はあるが一定程度の土地利用の規制が存在することや、手続きが煩雑になること等から独自条例制定が困難との指摘がある。そこで、都市計画区域外を含む線引き都市である愛知県岡崎市で運用されている独自条例による土地利用制度内容を調査し、以下のことを明らかにした。1）土地利用基本条例による手続きの一元化を図ることで開発業者への分かりやすさと手続き漏れを防ぐ効果を担う一方で、包括的土地利用の独自条例を非線引き都市にみられるような地域区分毎の立地制限や開発に関わる基準等は設定されていないこと2）全市の立地制限や開発に関わる基準は土地利用基本条例を始めとする各種条例で規定され、特に乱開発の懸念や河川の涵養機能保全を目的として、都市計画区域外では完了検査を実施するとともに都市計画法の開発許可対象から外れる駐車場や太陽光発電施設等も含めた100㎡以上の宅地造成を協議対象とする条例を定めることで開発をコントロールする仕組みと定めていること3）非線引き都市と比較して都市計画法の開発許可制度で厳しく規制誘導を図る線引き都市では、開発許可に届出勧告制ではなく、事前協議による誘導を上乗せする仕組みが選択されていると考えられることまた、一元的土地利用制度のもと市が都市農村両方の土地利用計画を担うデンマークにおいて、農村地域での土地利用規制として、農村地域を中心に立地が進む再生可能エネルギー関連施設の立地コントールの現状について調査した。
