1.昨年度に引き続きアメリカのLender liabilityに関する判決例の研究を行った。その結果、アメリカにおけるLender liabilityの社会的・経済的背景は、1980年代後半から生じた金融恐慌であった。それは、Saving&Loan associationの西部における破綻に端を発していた。そのため、Lender liabilityに関する重要な判決例は、州レベルの判決では、テキサス州やカリフォルニア州のものが多いことも社会学的に重要な特徴であると言われている。また、アメリカのLender liabilityの傾向として、貸し主である銀行と、借り主である企業ないしは消費者との間に、特殊の機関が介在することはないと言う点を、UC Berkeley,School of LawのProfessor Friedが強調していた。2.これに対して、日本の「住専問題」におけるLender liabilityーー但し、住専管理機構が、母体行の住専への借り主の紹介責任を追及しようと提訴を試みたものが唯一のケースであろうと思われるーーを考察する際には、母体行-住専-借り主(不動産会社、消費者等)というヒエラルヒーを基礎とした組織型の契約が存在する点が特徴である。前出のProf.Friedによれば、中間に位置する「住専」をsubsidiaries(子会社または付属会社の意)と定義して、この「住専」がsubsidiariesとして登場する点が、アメリカにおける問題状況と大いに異なると指摘された。この点は、私の問題意識でもあり、同じ意見を得られたことに意を強くした次第である。3.しかし、日本の「住専問題」をLender liabilityとして研究することには障害がある。それは前述したように、Lender(借り主)が貸し主を訴えた事案がほとんど見あたらず、公式または非公式の判例集にそれらの法律上の争点が現れないからである。従って、これらの問題点の研究は、文献に頼ることが出来ないためフィールドワークによって行わなければならない。それゆえ、今後は右の研究形態も課題として採り入れようと考えている。
