昨年度に引き続いて,因果関係が問題となった判例について,神経回路網ソフトを適用した。すなわち,昨年度対象から除外した自然的事情介在事例(被害者の体質など行為時の事情が介在したものと,行為後の自然現象が介在した事例の両者を含む)を対象として,裁判所認定の事実の特徴を,数個の項目(罪名,介在事情の事前・事後の区別,(研究代表者が独自に判断した)経過の典型性など)について数値化したうえ,これらを入力パターンとし,因果関係有無の判断を期待出力値として,ソフトウェアを作動させた。その結果,行為後の因果経過の典型性という,規範的判断を要する項目を入力パターンに加えるか否かによって,出力値の的中率の高低がきわめて明瞭に規定されることが明らかになった。このことは,裁判所の帰責判断が事案の「典型性」の有無に大きく影響されているという,これまでも予想された結論でもあるが,同時に,規範的な「典型性」判断をどのような「事実」から構成して判断してゆくかが,さらに検討を要する-困難と予想される-課題であることが,改めて認識された。今年度の研究においても,本研究の開始当初予定されていた正当防衛関係の判例については,検討を加えることができなかった。今後は,前述の残された問題に加えて,これら犯罪論体系上別個の領域に属する事例について,さらに研究を継続したい。
