本研究は、ハンス・ケルゼン（1881-1973）の民主主義論の成立過程を解明することを目的とする。民主主義と個人の自由および少数者保護の関係を中心に、ケルゼンの思想的発展過程を多民族国家オーストリアの歴史的文脈に位置付けつつ再構成する。本年度においてはケルゼンの未公刊資料をも利用しながら、次の通り研究を進めた。第一に、オーストロ・ファシズムの職能身分制国家論とマルクス主義のプロレタリア独裁論に対する批判的対決を経て、ケルゼンが民主主義論を展開していく過程を解明した。1920年代のオーストリアにおいて、議会制が左右の政治勢力から攻撃されるなかで、ケルゼンは政治的自律の観点から議会制民主主義を擁護した。1920年代半ばに公表された一連の諸論稿に基づいて、政治史的文脈に位置付けつつ民主主義論の発展を再構成し、『民主主義の本質と価値』（第二版、1929年）へと結実する経緯を詳らかにした。第二に、ケルゼンの民主主義論における憲法裁判所構想の意義を検討した。彼は権力分立に対する独自の見解に基づき、憲法裁判所の有する違憲審査制は民主主義と矛盾するものではないと考えた。彼によれば、憲法という最高次の規範に基づいて議会立法を審査する違憲審査制は、むしろ少数者の権利を擁護する民主主義にとって不可欠の制度である。オーストリア第一共和政憲法の起草過程におけるケルゼンの役割を検証した先行研究をも利用しつつ、民主主義と少数者保護・個人の自由との両立のために、ケルゼンがどのような制度を具体的に構想していたかを解明しようと試みた。前年度以来、オーストリア第一共和政初期における評議会制に対するケルゼンの見解に着目することで、行政に対する民主的統制、そしてそのための制度として行政裁判制度を重視した経緯を解明した。本年度は第三に、この研究の成果をまとめ、『政治思想研究』第22号で公表した。
