本年度は、これまでの研究に次の新たな研究成果を加え、初期から『憲法論』公刊までの時期におけるシュミットの民主主義論の形成過程を発展史的に再構成した。第一に、第一次大戦から敗戦と革命を経てヴァイマル共和政が成立するまでの時期におけるシュミットの思想的展開を再構成し、委任独裁論の形成過程を解明した。シュミットの日記帳に基づいて大戦中に彼が従事した軍務内容を調査し、その任務が契機となり執筆された論稿「独裁と戒厳状態：一国法学的研究」の成立過程を詳らかにした。また、近年公表されたテクストであるミュンヘン商科大学講師時代の講義録に対する検討を通じて、『独裁』以前の時期におけるシュミットのボダン論およびホッブズ論を把握した。第二に、『独裁』における主権独裁論と1920年代に展開された人民主権論、民主主義論との関係を考察し、民主主義をめぐる構想の発展過程を解明した。具体的には、『独裁』、『政治神学』、『現代議会主義の精神史的地位』、『人民投票と人民請願』等の一次資料に基づき、シュミットの人民主権と民主主義に対する見解の変容過程を検証した。第三に、同時代の法学者であるハンス・ケルゼンにより異なる視座から構想された民主主義論と比較することで、シュミットの民主主義論の相対化を試みた。まず、両者における方法論上の相違を明らかにするため、1910年代に両者が執筆した著作にまで遡り、神学法学並行論と擬制論をめぐる議論を比較した。次に、民主主義とプロレタリア独裁の関係に対する両者の対照的な理解を把握し、その背景には、ルソーの人民主権論に対する異なる解釈と受容が存在することを究明した。こうした両者の思想的関係を鑑みて、民主主義と個人の自由の関係を考察した。以上の研究成果は、昨年度までの成果と合わせて、博士学位論文として北海道大学大学院法学研究科に提出する予定である。
