项目摘要

2022年度は、研究計画に従い、欧州における地方分権化の理論面での検討を行った。欧州連合（EU）における地方自治原理として有名になった補完性原則については、主にEUと加盟国政府との関係を規定するために導入された経緯があるが、本研究において、補完性原則が生まれた原点において各国内での地方分権を促進する要素を持っていた点、それをEUが新規加盟国を迎える際に改革を促進するメカニズムとして活用してきた経緯を確認した。一方で、中央集権の傾向が強いフランスと、地方の権限の強いドイツの連邦制との間などでは、地方分権化の度合いに大きな相違が存在しており、EUの内部においても地方分権化の程度や態様について必ずしも合意が存在するわけではないと思われるが、2022年度の調査の限りでは、こうしたEU既加盟国側の事情が、新規加盟国の地方分権化や加盟交渉に影響を及ぼした証拠は得られなかった。一方で、2022年度中に研究分担者が実施した現地調査（ラトビアおよびボスニア・ヘルツェゴビナ）においては、旧体制（共産主義）時代の中央-地方関係が体制移行後の統治のあり方に影響を及ぼしている部分と、EUとの関係において地方分権化が進んでいる部分とがあることが確認され、地方分権化の複雑な態様の一端が明らかになった。この他、既存研究から、権限の種類によって地方分権化の度合いに差異が生じることを確認し分類を行った。これによれば、財政や人事に関する分野で特に分権化への抵抗が起こりやすく、これが名目上の分権化の効果を損なう場合も存在することが判明した。今後、2023年度中にこのような要素を反映して欧州における地方分権化の分析枠組みを作成し、体制移行国や紛争経験国に対する分析を進めていく予定である。
