项目摘要

本研究の目標を達成するための基本資料となる『仏蘭西法律書』について、本年度は第47回語彙・辞書研究会において「明治期前半におけるフランス民法の翻訳の差異―箕作麟祥訳『仏蘭西法律書　民法』と加太邦憲訳『仏蘭西民法』―」という題目で口頭発表を行った。この口頭発表は、フランス民法の翻訳書である、箕作麟祥『仏蘭西法律書　民法』と加太邦憲訳『仏蘭西民法』との訳語の比較を行い、両者にどの程度違いがあるのかを明らかにすることを目的としたものである。その結果、箕作の初訳版の『仏蘭西法律書　民法』（明治4年刊）と加太の翻訳した『仏蘭西民法』（明治16～18年刊）の訳語を比較してみると、確かに訳語の違いは随所にみられるが、文の構造が大きく異なる部分はほとんど見られず、全体的に加太訳は箕作訳を踏襲し、必要に応じて訳語を改編したものと見られることが明らかになった。この背景として、加太は箕作訳に満足せず、新たにフランス民法の翻訳を試みたが、箕作の訳から完全に脱却した翻訳をつくることは出来なかったことが考えられる。これは裏を返せば箕作によるフランス民法の訳が一般に受け入れられやすいものであったことを示している。また、明治期法律用語が他の専門用語と語種・語構成面での差異を検証するために、磯部四郎『民法応用字解』と『工学字彙』の用語の語構成を比較した。その結果、『民法応用字解』の語は他の専門用語よりも句訳が多く、音訳語が全くないことが明らかになった。また語構成としては、それぞれの漢語で他分野の用語に最も多く見られる形が、『民法応用字解』でも最も多く見られ、他の専門用語と同様のあり方をしていることがわかった。その一方で、『民法応用字解』の造語成分は2字漢語が圧倒的多数のため、1字漢語や和語等を使用した語構成が取れず、他の用語に比べ語構成のパターンがより固定化する傾向にあることが明らかになった。
