项目摘要

本研究は、ヘイト・スピーチ、ポルノ、幼児人形といった各種の有害・不快言論をめぐって規制派と擁護派の対立が先鋭化している現在において、憲法上規制可能な表現類型の性質を明らかにすることを目的にして遂行された。本年度は、わいせつ物が規制される実質的な論拠を明らかにするために、アメリカのわいせつ物規制に関するランド・マーク判決（Roth v. United States, 354 U.S. 476 (1957)）を素材に選び、当該判決が形成される過程にまで遡る調査を行った。その結果、本件以前には、わいせつ物の実質的な規制根拠として、①わいせつ物の表現としての価値の低さ（わいせつ物の低価値性）、②わいせつ物が惹起する社会的害悪（わいせつ物の有害性）という二つの根拠が挙げられていたが、本件が①わいせつ物の低価値性をその規制根拠として選択したことで、わいせつ物の規制根拠論の文脈から、②わいせつ物の有害性に関する議論が後退していったことが明らかとなった。もっとも、本件の口頭弁論の記録を調査しても、そうした選択がなされた理由を明示する記述は存在しなかったため、当該理由に関しては暫定的な可能性を明らかにしたに過ぎない。しかし、以上の調査の過程で、本件に関するオーラル・アーギュメントの所蔵場所を発見することができたので、今後は当該資料に関する調査を行う予定である。以上の研究成果に関しては、既に活字化しており、近々共著として公刊される予定である。また本年度は、國立臺灣大學で開催された日台の若手研究者向けの研究会で、わが国のわいせつ物規制に関する報告を行う機会があり、そこで様々な教示を得ることができた。

This study focuses on various harmful and unpleasant speech, regulation and advocacy, and constitutional regulation.
