The proposed research seeks to identify the deficiencies ofexisting dispute resolution mechanisms in financialdisputes, as well as the necessary elements of a potentialinternational treaty that could maintain a reliable conflictresolution system capable of sustainably supporting futuregrowth within global financial markets. The integrity ofdispute resolution is paramount due to the potentialramifications of inaccurate judicial decisions concerning theunderstanding of widely used model contracts in financialtransactions. This could create a cascade effect throughoutother deals influenced by the same model contracts, withpotentially destabilising implications for the financialmarket. The ubiquity of these standard form agreementscoupled with recent technological advances and theintricate nature of financial products necessitate a thoroughevaluation into current dispute resolution practices. To thisend, the proposed research will evaluate how New York andEnglish courts have contributed to international financiallaw while highlighting their respective limitations in today'sworld. Additionally, alternative dispute resolution systemswill be explored which may potentially address these needsmore effectively. Furthermore, a comprehensive cross sector comparison will be conducted across multiplesectors that comprise this landscape, allowing for a betterunderstanding of what market expectations are fordependable dispute resolution mechanisms.
