The Right to Inclusion in the Community: A Recognition-Theoretic Approach

People with disabilities are frequently excluded from full participation in society, in violation of modern human rightsstandards. This project looks to the disciplines of social ontology and critical theory in order to diagnose andgrapple with a cluster of hitherto intractable legal, ethical, and public policy dilemmas related to the right of personswith disabilities to live independently and to be included in the community (CRPD, Art 19). My hypothesis is that thenormative content of Art 19 can be better understood by understanding community as a set of overlappingspheres of mutual recognition and misrecognition, rather than simply as a forum where individuals exercise choice.I draw on Fanon's typology of othering to analyse exclusionary micro-practices of othering and misrecognition, andon Honneth's Hegelian unpacking of The Struggle for Recognition to develop practicable strategies for revisingpolicy and practice in order to realise the promise of Art 19.
