相比知识产权立法，中国知识产权文化建设相对滞后，这是引发创新外部性问题、制约企业技术创新的重要因素。法律精神建构需根植本土文化，研究表明宗族文化作为儒家思想在基层社会的文化载体，与知识产权文化有重要契合，这引发思考：宗族文化能否影响知识产权文化的法律精神建构，缓解创新外部性问题，以作用于企业技术创新？虽有研究分析了宗族网络与企业创新关系，却未基于文化主义研究范式考察宗族文化的影响，致使宗族文化与企业技术创新理论关系模糊。项目研究内容：①基于文化认同理论，揭示宗族文化对知识产权文化的建构作用；②基于外部性理论，厘清宗族文化的惩罚和声誉激励机制对企业创新外部性的影响路径；③基于社会资本与社会认同理论，探明宗族文化通过信任建立影响企业创新资源获取的作用规律；④建立宗族文化通过知识产权文化建构、外部性问题缓解、资源获取影响企业技术创新的理论模型。以此深化中国传统文化优秀元素在国家治理中的制度解析。

Compared with the legislation of intellectual property, the construction of intellectual property culture in China is backward, which may cause the externality of innovation and suppress the technological innovation of enterprises. Legal spirit construction needs to root in local culture. The research shows that the clan culture, as a cultural carrier of Confucianism in local community, reaches an important agreement with the intellectual property culture. This inspires us to think: can clan culture influence the legal spirit construction of intellectual property, as a result, boost technological innovation of enterprises by alleviating the externality of innovation? Although a bunch of research has analyzed the relationship between clan network and enterprise innovation, they do not pay attention to the influence of clan culture based on culturalism research paradigm. As a result, the theoretical relationship between clan culture and enterprise technology innovation is fuzzy. Project research content: Firstly, it reveals the role of clan culture in the construction of intellectual property culture based on the theory of cultural identity. Secondly, it clarifies the influence of the punishment and reputation incentive mechanism of clan culture on the externality of enterprise innovation based on the externality theory. Thirdly, it explores the rule of clan culture’s influence on the acquisition of innovative resources through trust building based on the theory of social capital and social identity. Finally, it establishes a theoretical model on how clan culture influences the technological innovation of enterprises through the construction of intellectual property culture, weakening of externalities and acquisition of resources at same time. This project will integrate the traditional culture elements of Chinese into national governance research.
