Research on design management model incorporating legal measure against imitative goods

这个项目的重点是澄清；i)何时提出外观设计权申请？ii)外观设计权注册的原因是什么？通常情况下，设计培训书教过的，应该是较早注册的理想样板。但是，在某些情况下，提前注册可能会使早期模仿成为可能。而外观设计权也不是万能的，传统的设计保护的自成文法和设计权标的法的变化（即欧盟的备件设计排除提案）会阻碍外观设计权的行使。综上所述，对设计师的教育应该包括“设计师应该如何了解复杂的设计尤其是三维物体设计的法律保护制度？”以及如何寻求第三方的权利。

The focus of this project is to make clarification ; i) When Design right application should be made? ii) What is the reason for Design right registration? Normally, design training book taught, earlier registration should be an ideal model. However, early registration could make a possibility of early imitation, in some case. And Design right is not almighty, because traditional design protection by sui generis law and changing law of subject matter of design right (i.e. EU proposal for spare parts design exclusion) could block exercising Design right. In conclusion, educating designers should be include "How should designers know the complex legal protection system for design especially three dimensional object design?" and how to search third parties' right.
