Comparative study about social welfare disputes in Japan and Sweden

在日本，公共长期护理保险制度实施后，在护理过程中发生了许多与意外事故有关的纠纷。根据法庭案例，服务提供者应根据需要长期护理的使用者的身心状况，提供适当的护理服务，并采取适当措施，保障使用者免受意外事故的伤害。提供者作为从事护理的专业人员，必须履行比在国内照顾需要照顾的家庭成员的人更高的义务。另一方面，在瑞典，有关社会服务法的纠纷可分为三类；哪个城市负责为一个人提供服务的问题，接受社会服务的条件是否满足的问题，以及服务水平的问题。在瑞典，从2009年开始实行一项关于社会服务自由选择的新制度。预计在新系统中如何保持服务水平将是一个新的课题。

In Japan, after the enforcement of the public long-term care insurance system, there have occurred a lot of disputes concerned accidents during care providing. According to court cases, service providers ought to provide appropriate care service in accordance with physical and mental situation of users who need long-term care and to take proper measures to secure users from accidents. Providers, as professionals who are engaged in nursing care, have to fulfill higher obligations than people who domestically take care of their family members in need of care. On the other hand, in Sweden, disputes concerning the social service act can be classified in three categories ; question of which municipality is responsible for providing service for a person, question of whether the conditions to receive social service are satisfied and question of the level of service. In Sweden, a new system about freedom of choice in social service is carried out from 2009. It is expected that it will be a new issue how to keep the level of service in the new system.
