The Transitional Law of Extradition in the Era of Fight against Terrorism and Organized Crime

本文旨在分析反恐战争和跨国有组织犯罪时期引渡法律制度的当代变化和发展。特别是在欧洲联盟的区域系统中，迅速和简化了引渡法律和程序，即：欧洲逮捕令本研究旨在分析这一新制度的优点和缺点。本研究特别强调了在新制定的引渡制度法律的各个方面保护人权的重要性。根据这一点，研究报告批评了美国对恐怖主义嫌疑人的特别引渡方案的做法。研究报告还审查了日本现行过时的引渡法，并提出了一些修正案，以反映国际社会最近制定的国际人道标准。

The purpose of this study is to analyze the contemporary changes and developments of the extradition law and system in times of war against terrors and transnational organized crimes. The speedy and simplified extradition law and procedure has been developed especially in the regional system of the European Union, i. e the European Arrest Warrant. The study intends to analyze the advantages and drawbacks of this new system. Particularly the present study emphasizes the importance of human rights protection in all the aspects of the newly developing law of extradition system. In line with this the study criticizes the practice of the extraordinary rendition program of terrorist suspects by the United States. The study also examines the present outmoded extradition of law of Japan and proposes some amendments to reflect the international and humane standards recently developed in the global communities.
