项目摘要

令和4年度は、EU基本権憲章の適用可能性の問題に関して、主に次の作業を行った。第一に、前年度に引き続き、EU基本権憲章の適用範囲を画する「EU法の実施」概念（EU基本権憲章51条1項）に関するEU判例の調査を実施した。前年までの主要判例の検討結果を踏まえて事案をいくつかの類型に整理し、類型ごとに判例が「EU法の実施」の有無を判断するにあたって考慮している諸要因を明らかにすることを試みた。とくに、手続・救済上の権利に対する制約が問題となった事案や、私人に対する構成国の制裁措置が問題となった事案を対象に、各事例での考慮事由について分析を行った。第二に、国内法の観点から、各国（ドイツ・イタリア・フランス等）における国内判例および文献の調査を継続して行った。調査を進める過程では、データ保護に関する事案において重要な国内判例が多くみられたことから（たとえば、トラフィックデータや位置データの保存義務等をめぐる欧州司法裁判所先決裁定（La Quadrature du Net, C-511/18, C-512/18 and C-520/18）と同裁定を受けて下されたフランス国務院判決（French Data Network, 393099））、国内判例の分析を行ううえで前提となるEU法上のデータ保護規制の内容を理解する目的で、この分野におけるEU判例の動向に関する調査も行った。また、国内判例に関しては、当初の予定よりも対象範囲を広げて、必要に応じて憲法裁判所だけでなく通常裁判所の判例の調査も補充的に実施した。
