项目摘要

本研究は、前近代日本の債権法制及び慣習に関する学問基盤の構築とそのための基礎的資料の整備とを目的とする。とりわけ、かかる研究の先駆者である金田平一郎が、戦前期九州帝国大学を拠点として蒐集した近世法制史料群に焦点を当て、未整理史料の目録整備やデジタル化を図りつつ研究を深め、関連する地域史料の活用可能性をも模索するものである。2年目に当たる本年度の主立った実績としては、以下の3点が挙げられる。まずは、九州大学所蔵の法制史料に含まれる未整理分のうち、昨年度に「大阪塩町四丁目(現・大阪市中央区南船場)記録」について、研究補助者(RA)の助力を得て整理が完了したのを受け、解題及び目録を公刊したことである。また九州地域の史料としては、昨年度に引き続き、九州文化史所蔵の豊前小倉藩領の大庄屋日記の一部の翻刻・紹介したのに加え、天草崎津文書の目録、またこれらの史料収集の拠点となった九州文化史の事務日誌も一部公刊した。2つ目に、金田文庫に含まれる債権関係史料、とりわけ北部九州地域の証文類につき、整理を進めると同時に、関連資料の調査・撮影・整理を行った。なかでも法制史料に含まれる筑後地域の未整理の文書群、また各種近世裁判関係資料は、引き続き重要な検討対象となろう。また蒐集過程及び現在に至るまでの保存・管理状況につき、図書館関係者への聞き取り調査も実施した。さらに口頭報告の機会を二度ほど得て、隣接諸分野始め様々な分野の研究者に資料状況の詳細を提示し、今後の整理・検討について多くの知見を得た。3つ目に、分析対象であるかかる史料群への理解を、背景にある問題関心も含めてより精密なものとするために、学問的に金田にも大きな影響を与えた法制史学のパイオニアである宮崎道三郎に関する検討を進め、論文を執筆・公刊した。

This study aims to establish a knowledge base for the legal system and customs of debt in pre-modern Japan. The focus of the collection of modern legal historical materials by Kyushu Imperial University is on the preparation of catalogues of unsorted historical materials and the possibility of using historical materials in relevant regions. Research and analysis of historical materials, understanding of historical materials, background, problems, concern, precision, knowledge, influence, legal history, discussion, writing, publication
