项目摘要

今年度はまず、前年度に執筆した近世琉球に関する論文の公表作業を行った。この論文は、近世琉球で盛んに行われた一連の修史事業の濫觴である17世紀後半の羽地朝秀による著作『中山世鑑』が、伝統的な中国の史書の枠組みに必ずしもとらわれない歴史叙述を通じて琉球の国制をはじめて自覚しており、自国の歴史とあるべき現実との葛藤が象徴的に析出されたことを明らかにしたものである。ここでは近世琉球を超えて、ある意味普遍的に歴史理解と法制度の形成との重要な関係を示す好個の手がかりが提供されており、法制史において中核の一となりうる問題を改めて提起したと同時に、日本近世期の「法」を、先例の理解を重要な手掛かりの一として分析する本研究の方向性を再確認出来た点でも大変有意義な作業であった。この後対象を幕府法に戻してこれまでの成果を纏めていた折、まさに近世期の「法」をめぐって、昨秋日本史研究者の側より法制史研究者との共同研究の提案がなされ(2004年度史学会第102回大会シンポジウム「近世の法と制度の再検討」)、報告論集への寄稿というかたちでの参加要請を受けた。本研究の目的とも合致するこの提案は、法制史学より歴史学分野に向けてのまたとない貴重な発言の機会であり、本研究の成果から近世最初期(慶長年間;17世紀前半)における『院内銀山籠者成敗人帳』を新たに取り上げて近世法、とりわけ蓄積が少なく本研究が対象とする近世前半期の法のあり方の大局的な見透しを示すことにした。同史料は現在の秋田県にあった院内銀山において、山奉行梅津政景の著した日記の中から刑事裁判についての記事を纏めた良質な法制史料でもある。ここでは成文法や判例法が未成立の中で、非常に論理的かつ緻密な捜査及び訴訟手続の存在を看取でき、近世前半期を考える上できわめて示唆的であるが、従来歴史学、殊に鉱山史や社会史の側からの研究に限られており、歴史学と法制史学の有機的な対話・発展を可能とする重要なフィールドたりうる(2005年11月刊行予定)。今後は歴史学からの反応も取り入れ、さらに個別具体的な見透しを示す纏まった著作の執筆を行う予定である。
