项目摘要

2022年度は、2021年度に深く検討ができなかった、カナダにおける複婚禁止の憲法適合性について研究を進め、その成果を現在、論文にまとめている段階である。また、研究実施計画書では当初2024年度に予定していた日本における複婚をはじめとした伝統的ではない婚姻形態の検討を2022年度に前倒しし、日本への示唆も同時に検討した。その理由として、2022年度は、本研究課題である日本国憲法24条の意義につき先行して論文や学会等にてにてその一端―－具体的には、24条は婚姻制度の構築等につき国家に立法裁量を与えているものの、14条1項が規定する平等権と整合するよう24条を解釈することで婚姻の自由により意義を持たせることができるという仮説―－を論じる機会に接し、そこで考察した理論の応用性を検討すべく、複婚の事例につき、同理論の適用可能性を論じる必要性が生じたからである。他方で、カナダと日本では、婚姻概念、とりわけ、宗教的な理由を背景としたカナダの複婚と日本におけるそれとでは分析の方法が異なる。例えば、カナダでは複婚の禁止は一次的には信教の自由の問題となるが、カナダの裁判所は複婚の禁止を平等権の問題と位置付けている。一方、日本では、複婚の禁止が直接的に争われた事例が存在しない。そのため、2022年度は、次年度以降の研究の布石として、複婚の禁止をめぐる憲法上の論点を抽出し、カナダにおける議論を踏まえた上で、日本では24条等の観点からどのように議論を組み立てることができるのか考察した。
