项目摘要

新型コロナウイルス感染症蔓延のため，国内及び国外での実地調査は，いずれも相手方の都合として実施できなかったことから，参考文献等を基にして，学会発表や，雑誌への論文投稿を行った。具体的には，２０２２年１０月９日に群馬大学で開催された日本医学哲学倫理学会で，「リビング・ウィルの法的位置付け」という表題で発表をした。当該学会発表において，尊厳死における患者の意思決定権の在り方として，リビング・ウィルが重要な位置を占めることから，それが民事法的にどのような効果をもつのか，それが公法的な影響力を持ち得るのか，さらに，刑事法的にも効力を持ち得ないかという幅広い観点からの検討を重ねて導き出した結論として，現在の我が国における種々の法制度下においても，その有効性，重要性は，法的に十分に価値を持ち得るものという趣旨の内容で発表を行ったものである。
