本研究は，契約条項の内容規制において，取引全体・契約全体との関連を考慮に入れる際に，どのような点に留意すべきか検討するものであり，これまでドイツ約款法の分析の結果，次のような研究成果が得られた。ドイツ約款法における不当条項規制では，「他の条項との相互作用」や「契約全体との関連」において，包括的な利益衡量を行う必要がある。不当性審査における考慮要素として，「契約全体の考慮」，とりわけ，他の条項との相互作用として生じる「補償効果」と「累積効果」が重要な評価基準となっている 。契約全体の考慮によると，ある条項による契約相手方の不利益が，他の条項による利益によって埋め合わされることがありうる。このような「補償効果」が認められると，当該条項は無効判断を免れることが可能となる。他方で，契約全体の考慮によると，単独では許容される内容の条項が，他の条項との相互作用の結果として，契約相手方に不当な不利益を惹起する「累積効果」を生じる可能性がある。「累積効果」が生じると，原則として，相互関連性のある双方の条項が無効となる。「累積効果」は，複数の条項の「組み合わせによる負の作用」が問題となる場合のほか，複数の条項による「些細な負担の蓄積」が問題となる場合にも生じうる。また，相互関連性のある2つの条項のうち，無効な条項が有効な条項にその無効性を「感染」させる結果，累積効果によって双方の条項が無効となることがありうる。引き続きドイツ約款法を分析するとともに，EU判例の分析検討も行う予定であるが，こうした研究成果は，新設されたばかりの民法548条の2第2項の解釈運用にあたり，新たな視点をもたらすものであり，学問的のみならず実務的にも重要な意義が認められる。
