国際人道法の規範の適用によって、武力紛争時の環境破壊および文化財の破壊に関する責任追及として、戦争犯罪に該当するか否かが問われた事案の検討を行い、その研究成果については、国際シンポジウムにおいて報告を行った。報告では、国際刑事裁判所が扱った事案を検討することで、国際法規範の適用に関する課題を明らかにした。武力紛争下の文化財に対する破壊行為は犯罪の重大性に鑑みて訴追されるべき戦争犯罪として責任が追及される。事例研究の結果、規範の違反行為として個人の刑事責任を問う際、犯罪の構成要件を満たす違反行為の類型、軍事的必要性、均衡性との関連で、違法性の判断基準が明確になった。また、本研究課題の内容については国際法学会のエキスパートコメントで研究内容を一般公開する予定である。現在、国際法委員会の「武力紛争に関連する環境の保護」原則草案において示された原則として、生態学的重要性を有する区域に特別な保護を与えるための保護地帯の指定と環境保護の可能性について検討を行っている。このような特別地帯の設定は、特に先住民によって重要な意味を有するもので、自然環境のみならず、文化的重要性を有する場所に保護を与えることの意義は多岐にわたる。国際法委員会が作業全体として想定しているように、武力紛争の最中のみならず、紛争後のフェーズにおいても、国家は環境保護のために適当な措置を取る必要がある。武力紛争の後に国際法が先住民と彼らのアイデンティティとの結びつきの象徴であり、生活の場である環境問題に、如何に取り組むべきかという課題は、国際人権法と人道法が交差する論点である。報告と検討の内容はジャーナルに投稿する予定である。

The application of norms of international humanitarian law, environmental and cultural property damage in armed conflicts, accountability, crime, investigation, research results, and international reporting The report addresses issues related to the application of international law norms in the context of the International Criminal Tribunal. Cultural property violations committed under armed conflict are serious crimes, and criminal responsibility is the focus of criminal investigation. The results of case study, the question of individual criminal responsibility for violations of norms, the types of violations of criminal elements, the necessity of military affairs, the balance of relations, and the criteria for judging illegality are clearly defined. The content of this research topic is generally open to the public. At present, the International Law Commission's draft principles on "Protection of the environment in relation to armed conflict" are discussed in the context of principles, ecological importance, special protection, and the possibility of designating protected areas for environmental protection. The significance of this special zone is different from that of the natural environment and culture. The International Law Commission is working together to determine the need for appropriate measures for the protection of the environment, the most important aspects of armed disputes, and the most important aspects of post-conflict situations. After the armed conflict, international law and the characteristics of the image of the ancestors, the field of life, the environmental problems, how to choose the group, the problems, international human law and humanitarian law. The content of the report is predetermined.
