项目摘要

本研究では、「法的判断における論証の役割はいったい何か、その役割は機械によって代替不能なものなのか」という問いを①機械の判断にはどのような特徴があるのか、また人間の推論実践との相違は何か、②法的判断における論証の意義と役割は何か、という二つの具体的な問いへと分割し、順次それらを解決することでこれに回答を与えることを目標としている。前年から引き続き、本年は特に②の問いに関する研究を継続した。前年の研究・調査の結果、そもそも法的議論や計算機科学における議論研究の進展について国際的な偏りがあることが見いだされたため、本年はその偏りや研究の状況、研究テーマの分析と整理に注力し、研究活動を進めた。まず、偏りの具体的な内容としては次の2つの点が見いだされた。第一に、法（哲）学における法的議論の研究については、日本の研究者が主として参照する英米独仏においては議論の進展があまり見られない一方で、イタリアやオランダといった国では継続的な研究課題として扱われており、実際に研究の進展が見られる。第二に、計算機科学における議論研究については英語という共通言語による研究成果が共有されることもあって法学に比すれば国際的に広く研究がなされているように見えるが、やはりイタリアやオランダの研究グループの存在感が際立っていることが見いだされた。また、こうした研究状況と連動して（あるいはその背景をなすものとして）、論理や議論についての研究がどういった研究文脈に位置付けられる研究課題なのか、という点についても国ごとに相違があり、その結果として「論理」「議論」という言葉で指す事柄にも多かれ少なかれ相違が見いだされた。そのため、年度後半ではこれを統合するための枠組みを探索し、整理することを試みた。こうした整理の試みについては試論的なものを日本法哲学会にて報告した他、関連研究者に構想を示して意見をもらうなどしている。
