项目摘要

本研究の目的は、裁判傍聴、関係者への取材、関係諸資料の分析といった3つのアプローチに基づいて、理論と実践における法廷通訳者の役割考察を行うことである。本研究の初年度は、法廷場面における戦略的談話と通訳の特徴を踏まえ、司法通訳全般に共通する倫理基準である「逐語的に正確に訳す」の意味とその役割規範の有効性を検証した。さらに、裁判所の通訳者への厳格な職業倫理の要求のほか、法廷通訳の正確性や役割範囲をめぐる法曹三者と通訳者の双方向からの多面的理解とお互いへの要求を明らかにし、現場が抱える協働の課題について考察した。本研究の二年度以降は、役割規範とは対比的な実践事例をもとに、通訳の職業的専門性とそれに伴う役割の多元性を議論し、法廷通訳者の役割規範に対する潜在的混乱と裁判所の取り組みに潜む課題を指摘した。また、法廷通訳者の社会的意義と役割を踏まえ、忠実な通訳に向けた法廷通訳者の担うべき役割への考察を深め、その研究結果を博士論文としてまとめた。本研究成果の一部は、2022年度から2023年度までの間に『Interpreting』、『Asian Journal of Law and Society』等の研究報告会と国際学術誌で公表する予定である。

The purpose of this study is to analyze the relationship between the source and the data, and to investigate the relationship between theory and practice. In the first year of this study, the characteristics of the conversation and communication in the legal situation were examined, and the ethical standards of "verbatim correctness" and the existence of service norms were verified. In addition, the court's communication standards, the requirements of professional ethics, the legality of court communication, the scope of service, the three aspects of law, the understanding of the two sides of communication, the requirements of mutual understanding, the investigation of the topic of on-site cooperation. In the second year of this study, the potential confusion of the judicial system was pointed out by the practical examples of the decline and the division of labor norms.
