项目摘要

令和2年度は、動物法の担い手研究を主に行い、4点の成果を上げることができた。第１に、EUの市民参加制度のひとつであるEU市民イニシアチブ（European Citizens’ Initiative、ECI）に着目して検討し、動物実験の廃止を求めた“Stop Vivisection ECI”の限界と意義を明らかにした。検討結果の一部は、オンライン開催された「一橋大学EU法研究会」において報告し、EU法研究者から有益なコメントを得ることができた。第２に、EU構成国であるドイツにおける動物保護法の展開を検討した。「動物保護法」のコンメンタールを精読し、ドイツにおける動物保護法の展開について調査した。とりわけ、ドイツにおける動物の権利論の議論がアメリカのそれとは異なる形で展開されていることなどが明らかになり、本研究における理論研究の進展の兆しが見られた。第３に、アメリカ法に関しては、連邦法の「動物福祉法」（Animal Welfare Act）における動物実験施設に対する査察制度を検討し、その検討結果を『一橋法学』において公表した。第４に、日本における動物法の総合的調査に着手した。本研究の最終目的は、「日本の動物観に合った動物法を実現する形とはいかなるものか模索すること」である。そこで、日本における動物に関連する制定法・判例法の展開を分野横断的に検討するため、文献収集・資料収集を行った。とりわけ、英語で書かれた日本の動物法に関する文献、動物に関する裁判の情報の収集、検討を行った。今後はこの総合的検討の結果の概要を英訳し、公表する予定である（Oxford University Pressから2022年に出版予定のOxford Handbook of Global Animal Lawの日本パートを分担執筆決定済）。
