项目摘要

日・米・欧における動物福祉法の比較検討を行う本研究において、最終年度では（１）愛玩（２）畜産（３）実験動物に関する法律についての展開を検討し、国内外の学術的な場や一般市民向けの場において発表した。（１）まず、愛玩動物については、アメリカにおける判例法の展開を分析した。その結果、動物自身の利益を考慮した判決が見られることが明らかになった。また、近年わが国で注目を集めている犬・猫の殺処分を取り巻く問題を扱った一般書を刊行した。刊行後は、一般の方向けの刊行記念セミナーなどのアウトリーチ活動を行った。（２）次に、畜産動物については、アメリカのハーバード大学と中国の人民大学において、畜産動物に関する法の日米比較について報告した。日本における採卵鶏の福祉に関するこれまでの法的扱いと近年の動向を分析した。"Animal Welfare"という西洋由来の概念を日本語で表現する難しさが日本における同概念の理解の障害になっている。これらの分析結果をハーバード大学のワークショップで報告し、国際的・学際的な議論を行った。また、人民大学における報告をまとめた英語論文を同大学の紀要に投稿済みである。（３）最後に、実験動物法については、EUにおける化粧品動物禁止規定を理念から実際の働きまで詳細に検討した研究結果をまとめ、『一橋法学』に投稿、刊行した。先進的であると評価されることが多いEUの動物福祉法であるが、実際の法の働きを検討した結果、例外規定の存在などを見落とした理解がなされていることなどが明らかになった。しかしながら、同時に、動物福祉を漸進させようという緻密で現実的な議論が20年という長い時間をかけて重ねられてきたことも事実であり、EUは「着実な歩み」を進めていると評価できることを示した。以上、日・米・欧における動物福祉法を分野・地域横断的に検討し、各法体系における漸進的な展開を明らかにした。
