项目摘要

令和4年度は、おおむね以下の課題を遂行した。第一に、令和3年度に引き続き以下のような検討を行い、論文としてその知見を社会に還元した。具体的には、以下の通りである。すなわち、イギリスにおける議会主権の原則は、政府と議会の関係を規律する側面も有している。そして、そうした側面は現代の判例においても登場することがある。しかし、イギリス議院内閣制は政府と議会の「融合」が常であるはずである。そうであるならば、議会主権の当該側面はなぜ現代の判決において援用されるのか。それはなぜなのか。こうした問いに対し、そうした「融合」にあっても政府派議員の造反は決して珍しいことではなく、そうした造反において明らかとなる政府と議会の「分断」の局面において、議会主権の当該側面が援用されていることを明らかにした。第二に、日英議院内閣制の法的構造の相違を検討すべく、イギリス議会において政府派議員統制の役割を担うとされてきた院内幹事（whip）につき、その法的な権能の有無や内容を検討した。そこで明らかとなったのは、院内幹事は政府派議員統制のために大きな権能を有していると理解されてきたのに対し、実際はそうした権能をさほど有していないという点である。第三に、一連の検討から明らかとなったイギリスの議院内閣制の法的構造の特徴と照らし合わせつつ、日本の議院内閣制の法的構造を検討した。具体的には、まず、戦後日本の議院内閣制がいかに形成されてきたか、日本国憲法の制定過程の議論を検証した。次に、日本の国会において与党議員統制のために会派執行部がいかなる権能を有しているか考察した。
