项目摘要

本研究は江戸幕府の最高裁判所ともいうべき評定所が、江戸の三奉行所と一体性をもって幕府中央の裁判機関を構成し、然るべき役割を果たしていたことを明らかにすることを目的とする。そのためにいくつかの課題を設定した。令和3年度は、まず上訴の問題に取り組んだ。江戸時代の裁判制度は一審制であり、現代のような上訴という制度はなかった。そのため、一度きりの裁判の判決に到底納得できず、領主・地頭の裁判所の判決や裁判に強い不満を抱く者が少なくなかった。その結果、訴訟当事者が江戸の三奉行所に出訴することがしばしば見られた。その場合、結果的に評定所で裁判が開始されることもあったことを明らかにすることができた。実質的な上訴と言ってもよいであろう。領主・地頭を統合する中央権力としての幕府が、領主・地頭の裁判所の裁判や判決に強い不満を抱く人々に実質的な上訴を認めることにより、領主・地頭の裁判のほころびを補い、幕藩制国家の秩序維持に務めていたことを明らかにすることができた。令和3年度のもう一つの課題は裏書システムである。それは、訴状に江戸の奉行が裏書をして訴訟を受理するシステムである。全国各地の裁判所の管轄外の訴訟は、江戸の評定所、奉行所が裁判権を持つ。人々は評定所に直接提訴することはできないので、まず江戸の奉行所に出訴する。奉行所は訴状審査ののち、訴状に奉行の裏書を与えて訴訟を受理する。この訴状裏書により訴訟の係属先（評定所か担当奉行所か）が決まる。この訴状裏書の問題は、裁判管轄の問題と複雑に絡み合う問題であるが、次の三つの観点から訴状裏書の問題が考えられていたことが明らかになった。（1）訴訟人（原告）の住所地を基準とする考え方、（2）訴訟人の身分を基準とする考え方、（3）訴訟物を基準とする考え方。従来の研究は（1）を中心に論じていたので、この発見は一つの成果と言えよう。
