项目摘要

本研究の目的は、成年後見人の身上監護に関する職務範囲を探ると共に、後見制度の利用者がメリットを実感できる制度の実現に向けて、家庭裁判所による「許可制度」の発展可能性について検討を行うものである。昨年度に引き続き、令和４年度も新型コロナウイルスの影響で、家庭裁判所の職員や成年後見に携わる機会の多い実務家からヒアリングを行うなどの実態調査は難しかった。そのため、令和４年度も、昨年度に引き続き文献研究を中心に行った。具体的には、ドイツのコンメンタールや論文を中心に、いわゆる医療同意や被世話人が自由剥奪を伴う施設に収容される場面において世話裁判所がどのように許可を付与しているのか等を分析した。裁判所が許可をすることは財産管理面においては、主に世話人に対する監督という側面が強いと思われるが、医療同意や施設収容のような身上監護に関わる場面での「許可」は監督機能のみならず、世話人（後見人）の責任を軽減することにもなり、後見制度の利用促進の観点からは意義があると思われる。以上の分析結果については令和４年度中に公表するには至らなかったが、2023年1月施行の民法改正で大きく改正されたドイツの世話法（未成年後見法も含む）を分析対象として引き続き検討を行い、次年度、公表したいと考えている。一方、日本では家庭裁判所が「許可」を与えることで後見人等に監督を行うことは制度上、少ないが、令和4年3月25日に閣議決定された「第二期成年後見制度利用促進基本計画」においても家庭裁判所に期待されている役割はより大きなものとなっており、そのような観点からも本研究を進めていきたい。

The purpose of this study is to explore the relationship between adult personal guardianship and the role of the system, the users of the system, the development of the system, and the possibility of the development of the "licensing system" in the family court. In 2005, the Ministry of Justice and the Ministry of Justice issued a report on the impact of new types of criminal investigation, family court staff and adult cases. In 2004, the Ministry of Education and the Ministry of Education issued a document on the establishment of the Ministry of Education. The concrete analysis includes: medical consent; deprivation of liberty; establishment of conditions; permission to be granted; and so on. The court permits the management of property, the supervision of the host, the supervision of the host. The above analysis results show that in the fourth year of the year, the public table will be revised to the next year. In January 2023, the civil law will be revised to the next year. On March 25, 2004, the Cabinet decided to issue the "Second Basic Plan for Promoting the Use of the Adult Age System" to the Japanese Family Court.
