本研究の目的は、子ども保護に向けた総合的法システムの構築を目指し、その基礎的研究を行うことである。当初は、親権者による濫用的な財産管理権行使から未成年者の財産を保護する法システムが現行法では十分ではないとの立場を出発点に、立法論として、家庭裁判所による許可制という事前的規制を導入することの是非の検討を行うことに主眼を置いていたが、現在では未成年後見制度についても視野に入れて検討を行っている。というのは、未成年者を保護するのは原則として親権者であるが、場合によっては未成年後見人が就任する。したがって、子ども保護のシステムを検討する上では、親権と未成年後見との関係を分析する必要があり、それはまた同時に、未成年後見の果たすべき役割についても検討するということにもなる。わが国では、未成年後見についてはあまり十分な議論がなされてこなかったといえるので、その点でも意義のあるものと考える。本研究の出発点は親権者の財産管理権の分野であったが、身上監護との関係も考慮する必要がある。親権後見統一論の意義、成年後見制度との関係、成年年齢に関する議論など分析軸についての関心も広がっている状況である。他方、ドイツで行われている家庭裁判所による許可制は後見の場合も、親権の場合より制限を受けた制度として存在する。ドイツにおける親権と未成年後見の法状況とも比較し、今後も子ども保護に向けた総合的法システムの構築に寄与でるような研究を進めていきたいと考えている。
