项目摘要

令和４年度においては、前年度までの研究を継続しつつ、年度中に新たに生じた動きについても研究対象として取り入れるとともに、研究の取りまとめに向けて作業を進めた。具体的な研究実績は次の通りである。第1に、前々年度より検討を行っていた海洋環境保護の問題について、論文を公表した。この論文では、国連海洋法条約第12部に含まれている海洋環境の保護・保全義務に関する一般的義務が、国際裁判所の裁判・勧告的意見を通じてより具体化されてきており、このような動きの中でそのあり方自体も変容してきていることを示すとともに、国際裁判所による一般的義務の具体化の限界に関する問題についても指摘した。第2に、国連海洋法条約の紛争解決手続の限界に関する問題として検討を続けていた南シナ海紛争について国内学会での報告および国際シンポジウムでの報告を行った。これらの報告では、義務的な紛争解決手続の下で得られた仲裁判断が関係国間の海洋紛争にとって持つ意義を中心に整理を試みるとともに、紛争解決手続をはじめとしたメカニズムによって国連海洋法条約体制のレジリエンスが確保されているという点を議論した。第3に、前年度より検討を行っていた国際司法裁判所（ICJ）のインド洋における海洋境界画定事件（ソマリア対ケニア）本案判決を踏まえて、境界未画定海域における権利義務の内容について国際シンポジウムでの報告を行った。また、国際海洋法裁判所に気候変動に関する勧告的意見の要請が新たになされたこととの関係で、国連海洋法条約の紛争解決手続と勧告的意見との関係について検討を行った。
