これまでの研究のまとめとして、さしあたり我が国における議論を整理・分析し、京都大学にて開催されている京都刑事法研究会で報告を実施した。同研究会には現役裁判官も参加しており、自説に対する実務的観点からの指摘等を受けることができ、非常に有益な意見交換ができた。研究報告の概要は以下のとおりである。犯罪の終了時期＝公訴時効の起算点が争点となった判例を分析すると、判例はそれを、結果発生時、特に最終結果発生時だと解していることが分かる。そこで、構成要件的結果に着目して犯罪類型を分析した場合、（1）法益状況の変化を構成要件的結果とする犯罪類型と、（2）法益状況の変化＋当該状況にあることも構成要件的結果だと捉える犯罪類型が存在しているのが分かる。私見によれば、死体遺棄罪における「遺棄」とは、葬祭義務者による適時・適切な埋葬が行なわれない（おそれを生じさせる）ことであるが、この場合、葬祭義務者による作為の死体「遺棄」には二面性がある。すなわち、①（他の）葬祭義務者の埋葬を困難にする＝死体の置かれている状況を変化させて一般的宗教感情を害するという側面と、②葬祭義務者が埋葬をしない＝死体の置かれている状況それ自体が一般的宗教感情を害するという側面である。①は上記（1）に対応し。②は上記（2）に対応する。一方で、葬祭義務者による不作為による死体「遺棄」の場合、②（および（2））の側面しか存在しないがゆえに、葬祭義務者が埋葬義務を履行しない限り、構成要件的結果が発生し続けていると解さざるをえず、犯罪の終了時期＝公訴時効の起算点が到来しないことになる。もっとも、半永久的に犯罪の終了時期＝公訴時効の起算点が到来しないことは被疑者・被告人にとって多大な不利益であるから、事実上葬祭義務履行が不能な時点でそれが到来すると解する余地はあると思われる。
