当年度は、前年度の日本保険学会令和3年度大会（2021年10月24日）の学会発表のための調査過程で得られた知見を踏まえて、論文をしてまとめて公表する予定であったが、年度前半から新型コロナの関係で体調を大きく崩し、研究の時間がほとんどとれていない。このため最終的には、当年度も補助事業期間延長を申請するに至っている。ただし、本研究課題のテーマである約款論の本質にかかわる論点として、約款における契約説について、日本のスポーツ仲裁事例を手がかりとして検討し、論文として公表した（「約款における契約説の意義に関する一考察―スポーツ仲裁自動応諾条項に関する仲裁判断を契機に」『これからの民法・消費者法（Ⅱ） ― 河上正二先生古稀記念』463-480頁（2023年、信山社））。また、同じく約款論と重なる学問領域である消費者契約論について、ローマ法に遡って後見的介入の意義を明らかにしたドイツ法論文について、その翻訳を担当した（コージマ・メラー「〈翻訳〉消費者保護法における「時間」という名の後見人」『これからの民法・消費者法（Ⅰ） ― 河上正二先生古稀記念』99-116頁（2023年、信山社））。本研究課題については、既に2021年度より関連する研究課題が採択されており（武田直大「事業者間契約における不当条項規制に関する近年のドイツ法の議論の比較法研究」基盤研究(C)・2021年～2024年）、今後はその成果も精査しながら、本研究課題の方向性をまとめなおし、成果論文を公表したい。

In the current year, the order of the Japanese Society for Environmental Protection and the investigation process of the 3rd Annual General Meeting of the Society (October 24, 2021) were obtained. The paper was published in the public table. The relationship between the new type of research and the system was adjusted in the first half of the year. The time of research was changed. The final application for the grant period of the current year This research topic is about the nature of contract theory, the argument of contract theory, the arbitration case of Japan. Paper No. 2 ("An Investigation into the Meaning of Contract Theory-- Consumer contract theory, legal theory ($>·$>"Consumer Protection Law" Time " This research topic is related to the research topic in 2021.(Takeda Naota "Comparative Study of Recent Legal Arguments on the Regulation of Improper Terms in Business Contracts" Base Study (C)·2021 - 2024). Future Results are reviewed. The orientation of this research topic is discussed. Results are presented.
