项目摘要

2022年8月、国際連合ジュネーブ事務局で開催された障害者権利条約初回対日審査への参加により、本研究の範囲が拡大し進展した。政府とCRPDの本審査（建設的対話）とNGOとCRPDの事前情報交換（プライベート・ブリーフィング）を傍聴することによって、障害者法制に関して、政府・当事者・CRPDの見解の相違が明らかになった。特に、インクルーシブ教育と性虐待・性暴力防止のための包括的性教育について審議内容をまとめ、政府回答の問題点、今後の課題を整理した。この成果は現在、学会誌に投稿中である。インクルーシブ教育が進まない要因は、インクルーシブ教育についての文科省とCRPD解釈の相違が要因であった。現在、審査内容を基に、差別分類と合理的配慮の私法上の効力について分析中であり、これを2023年度の課題としたい。また、特別支援学校において障害児が歩行訓練中に心肺停止となった判決を分析し、学校の安全配慮義務の射程範囲について分析をした。この成果は、問答集学校事故の法律実務追録第111・112号に掲載された。2020年の民法改正により、一部の知的・精神障害者のうち意思能力が欠如した者が締結した契約は無効と規定された（民法3条の２）。障害者の地域で暮らす権利として重要な問題であるため、意思無能力者の契約に関する国内判例整理、全国銀行協会へのインタビューを行った。その結果、改正民法3条の２は判例法理の維持であった。そして、全国銀行協会は、意思無能力者との契約についてガイドラインを作成しているものの、実際には現場の行員の判断に委ねられていた。全国銀行協会は意思無能力者の成年後見の利用を勧めているが、条約の観点からいえば成年後見制度は意思決定支援ではなく代理決定であり、自己決定権の侵害といえる。この成果については第27回日本在宅ケア学会学術集会においてシンポジストとして報告をした。
