本研究は、17世紀後半から18世紀後半のドイツ・ザクセン選帝侯領を例に、中傷や挑発といった名誉にかかわる「言葉の暴力」、および傷害などの身体的暴力、とりわけ名誉と結びついた暴力の特殊形態としての決闘に対する規制や処罰の特質を明らかにすることを目標としている。加えて、暴力事件に関する言説や認識を裁判記録や知識人の著作などから読み取り、暴力に関わる怒りや恥、恐怖といった感情的次元をも検討することを試みたものである。初年度は先行研究の整理と史料収集を課題とした。ただし、コロナウィルス感染の状況が好転しないことにより、ドイツの文書館（ザクセン州立中央文書館ドレスデン館やマルティン・ルター大学ハレ・ヴィッテンベルク文書館）を訪問する形での史料調査や収集を行うことはできなかった。それでも、ザクセン州立中央文書館ドレスデン館とは直接コンタクトを取り、整理番号などを予め把握できていた所蔵史料数点をデジタル化された形で入手することができ、その際の手数料や複写費は本研究費より支出した。本研究における重要な課題である決闘の性質の検討に関しては、史料の入手状況にも鑑み、法規範や裁判記録以外に、（すでにデジタル化されておりオンラインで入手できる）当時の知識人の著作の分析にも着手した。その第一歩として、法学者アハスヴェールス・フリッチュによる学生の決闘に対する提言を分析し、決闘に対する描写や批判の特徴を検討した。その成果となる論考は2022年度末までに学内紀要に投稿を終えており、2023年6月に発行予定である。

This study focuses on the special forms of violence and the characteristics of regulation and punishment in the late 17th century and the late 18th century. In the early years, the task of organizing and collecting historical materials was carried out. This study is an important topic to discuss the nature of the decision, including the analysis of the works of the intellectuals at that time, in addition to the analysis of historical data, legal norms and judicial records. The first step is to analyze the characteristics of the students 'decisions. The results will be reviewed at the end of 2022, and will be published in June 2023.
