项目摘要

本研究は、16-18世紀のドイツ・ザクセン選帝侯領の大学都市ライプツィヒを例に、当時の法規範のみならず暴力事件を扱う裁判の記録をも分析することで暴力の形態や経過における名誉の意義を明らかにすること、さらに名誉と結びついた暴力の特殊形態としての決闘の性質や公権力による禁止の論理、当事者と目撃者の認識の相違などを多角的に検討することを目指したものである。前年度と同様に2022年度も、ドイツの文書館（ザクセン州立中央文書館ドレスデン館とライプツィヒ市立文書館）を訪問する形での史料状況の調査や収集を行うことはできなかった。それでも、前年度に引き続いて両文書館とコンタクトを取り、整理番号などを予め把握できていた所蔵史料数点（いずれも17世紀後半から18世紀初頭の決闘に関する裁判記録など）をデジタル化された形で入手することができ、その際の手数料や複写費は本研究費より支出した。本研究における重要な課題である決闘の性質の検討に関しては、2020年に発表した17世紀後半のザクセン選帝侯領における決闘禁止令の翻訳を踏まえつつ、上記の形で入手していた決闘に関する裁判記録の分析を進めた。ライプツィヒの事例については分析が進んでいないものの、同じくザクセン選帝侯領内の都市フライベルクで1673年に発生した決闘に対する裁判記録を用いて、決闘禁止令と裁判での扱われ方を対比的に検討した。その成果となる論考は2022年6月発行の学内紀要に掲載された。

This study analyzes the legal norms of the 16th-18th century and the records of violent events, judgments, and the forms of violence, the meaning of reputation, the special forms of violence, the nature of public power, and the logic of prohibition. The parties and witnesses know each other differently. In the previous year, the same year, the 2022 Municipal Document Museum (the National Central Document Museum and the Municipal Document Museum) visited the historical data collection of the shape. In the past year, the number of historical data collected in the library was selected and sorted out.(The judgment records related to the decisions of the late 17th century and the early 18th century were included.) The cost of copying the historical data was included in the cost of this research. This study is an important topic to discuss the nature of the decision, and to further analyze the judgment records of the late 17th century electoral system in 2020.
