本研究は、17世紀後半以降のドイツ・ザクセン選帝侯領の法規範及び裁判史料を分析し、傷害や殺人だけでなく、高度に儀礼化された暴力として発展した決闘をも含め、当時の暴力犯罪の形態や性質、さらには暴力を説明あるいは正当化する言説や暴力に対する態度とその変化をも検討することを目的としたものである。本研究は、16世紀後半から17世紀前半のザクセン選帝侯領内の都市ライプツィヒの暴力犯罪を論じた博士論文を前提としつつも、17世紀後半以降の分析を主たる対象としているため、当該時期に関する史料については改めて所蔵状況の確認や入手、分析を進める必要があった。ザクセン州立中央文書館ドレスデン館に所蔵されているザクセン選帝侯領規模の決闘禁止令や関連法規については本研究開始前に入手出来ていたものの、当初初年度に計画していたハレ・ヴィッテンベルク大学文書館やライプツィヒ市立文書館での史料収集は、コロナウィルス感染状況が好転せずドイツへ渡航できなかったために実現しなかった。他方で、本研究の初期の段階として、中世後期から18世紀に至るザクセン選帝侯領の法規範や諸命令の集成で、すでにデジタル化された史料であるCodex Augusteusに収録されている決闘禁止令の分析に着手した。決闘禁止令が明確にその姿を現す1650年代以降に注目し、1653年のものと1670年のものを史料翻訳の形で紹介した。その解題の中では、犯罪史研究の成果も踏まえて、決闘が他の暴力犯罪と区別されて扱われていく17世紀から18世紀にかけての歴史的過程に注目するべきことを提起した。この成果によって本研究の意義や方向性の一端を示すことができた。
