项目摘要

本研究課題は、行政法における参加権について、ドイツ法やヨーロッパ法を比較対象としながら、参加権とはいったいどのような権利であるのか、いかなる法的根拠に基づいて制度化されるべき権利であるのかといった点について明らかにすることを目標としている。本年度は、当初の計画通り、日本国内法における参加に関する議論について整理することに注力している。また、これらの作業の過程において、関連領域として、公共空間に関する他分野の研究者及び実務家を招聘して研究会を実施することで、従来の問題意識を拡大しつつ、現実社会や実務レベルでの問題に目を向けるよう努めた。また、2年目以降には特に海外（ドイツ・フランス・EUなど）における参加権をめぐる議論を参考に比較法研究を実施する予定であったが、新型コロナウィルスの影響により文献の調達が不安定な状況が続いていることから、本年度はこれらの文献収集についても並行して行った。これにより、次年度以降の研究計画遂行のための基盤が形成されたほか、比較法研究を前倒しで進めることで、次年度以降の検討課題をある程度明らかにすることができた。このほか、2022年度末には関連する研究会を実施し、研究課題に関する構想報告の機会を得ることで、問題意識と課題について一定の整理を行うこともできた。その結果、2023年度については、ドイツ・EU法における手続的権利に関する議論を取り上げ、総論的な検討を行うとともに、2024年度により具体的な参加権の検討にシフトしていくことを予定している。
