项目摘要

本年度は、ドイツ連邦憲法裁判所の判例分析を中心に作業を行う計画であった。具体的には、ドイツ連邦憲法裁判所において、近時、プロセスに着目した統制が採用されるケースがみられるところ、それらの事例分析を行い、その法領域的特性を明らかにすることを当該期間の課題とした。この成果として、①「立法過程の構造と解釈―その序論的考察―（１）（２・完）」(自治研究99巻2号～3号)、と題した論文では、近時のドイツ連邦憲法裁判所の判例を端緒として、法律制定過程をめぐる憲法理論について、行政手続に関する議論との比較という観点からその特質を明らかにした。また、上記の研究に並行して、日本における国会及び行政の判断過程の把握にも着手した。その成果として、②「More Freely！―生存権とその可能性」法学セミナー818号、③「学校運営協議会の法構造についての一考察」教育学部論集34号がある。②は生存権の実現を支える仕組みをめぐる判例法理を概観し、裁判所による統制手法を分析したものであり、③は教育行政過程の一齣である学校運営委員会の判断過程を形づくる手続について、憲法価値から考察した。③については、研究会報告も行った（関西行政法研究会1月例会）。とくに①については、従来は手薄であった立法過程の憲法的把握について、これを行政手続と比較して行う検討であるという点で新規性があり、また、後の研究計画の基盤ともなりうるものに位置づけられる。
