项目摘要

本研究は、(i)命令と行政規則の区分規準である「授権」と「法的拘束力」の関係性にかかるドイツの議論を把握すること、(ii)命令への授権にとって一般的である「規律の専門性・迅速性」や「議会の負担軽減」の要素、および命令への議会の関与形態の意義を解明することの二段階で進められる。(i)については前年度に完了したため、平成２８年度はドイツ公法学の議論を参照しつつ、（ii)について研究を進める計画であった。計画を遂行する中で、我が国のこれまでの通説的見解では、命令への委任の正当化根拠について十分に議論が深められておらず、その論証構造に欠陥を内包していることが判明した。そこで当初の計画を一部変更して研究を進めることとなった。具体的には、我が国の議論に導入可能なアプローチを提示するべく、ドイツ公法学で展開されている、法規命令・行政規則の制定権限の正当化を積極的に論証することを試みる諸見解を、大きくは二つのアプローチに分類したうえで、それぞれの議論構造をドイツ公法学内在的に検討した。その結果、命令が有する「議会の負担軽減」機能は、議院内閣制を採用する我が国においても命令への委任を憲法上正当化する要因となりうることが明らかとなった。また、「規律の専門性・迅速性」は、法律レベルで命令に投入可能なものと位置づけられた。「議会の負担軽減」機能それ自体の意義の検討は課題として残されたままであるものの、当該年度の当初の計画に照らしても、一定の成果を得ることができた。
