项目摘要

本研究は、既存の数多くの多数国間環境条約のうち、条約によっては採択後に条約の目的を必ずしも十分に達成しているとはいえない状況に照らし、当該条約の形態などを手掛かりに、環境条約の成否を分ける要素はなにかを検討する。また、環境諸条約がどのような方法を用いて、条約の目的を達成しようとしているかなどを整理することを通じて、環境条約の実効性の評価とその手法を明らかにすることを目的としている。令和4年度は、先行文献を中心とした文献調査を行った。具体的には、「特に水鳥の生息地として国際的に重要な湿地に関する条約」（ラムサール条約）において、これまでに採択された条約実施のための戦略計画やガイドラインに関する決議を整理し、その変遷を検討することにより、課題を抽出した。なお、2022年11月にラムサール条約第14回締約国会議が開催され、今後の条約体制の在り方が検討された。しかし運営体制の抜本的改革が前回会議で謳われたが、本会議においても継続審議となった。ラムサール条約の目的を達成するために、どのように条約を運用していくべきかについて、引き続き検討する必要がある。なお、環境条約の実効性の確保の側面からは、条約間の調整に関わる事例の収集・検討を行った。具体的には、我が国で最初のラムサール条約の登録湿地である釧路湿原に焦点をあて、登録に至る経緯や地元住民の理解を含むCEPA（コミュニケーション、教育、参加、啓蒙啓発のことであり、ラムサール条約における湿地保全のための柱のひとつ）の実施について、当時の担当者にインタビューを実施した。また併せて、釧路湿原と姉妹湿地協定を締結しているハンター河口湿地も訪問し、同湿地のラムサール担当官にもインタビューを行った。双方の意見を伺うことにより、湿地保全の手段として姉妹協定の重要性について確認し、実施状況や協定に対する認識の相違などを検討することができた。

The agreement on wetlands in Kushiro was concluded. The two sides agreed on the importance of wetland conservation measures, the status of implementation, and the understanding of violations of the agreement.
