本研究は、戦前期における心身に障害のある免囚者の保護と更生にかかわる実態を解明することを目的とし、(１)戦前期の免囚保護事業における「不具廃疾」の刑余者に対する保護に関する取り組みを明らかにする、(２)心身に障害のある刑余者の出所後の地域生活及び保護に関する取り組みを明らかにする、の二つの課題を設定している。2022年度は主に（１）の課題に注力し、高齢や病気・障害などのために生活困難となった免囚者に対する保護が、いつ頃どのように始まり、拡大・変容していったのかを解明するとともにその要因について分析した。その結果、「不具廃疾」者は明治20年代の別房留置制度における神経症や身体虚弱者の長期収容の実態からその存在が認識されていったことが分かった。明治後期になると、別房留置制度の廃止と恩典出獄者への対応を契機として、宗教者を中心とした保護活動が盛んとなり、その経過において「不具廃疾」者の刑余者への保護が拡大していったことが確認できた。とりわけ先覚的にこの分野を担ったのは、東京出獄人保護所（原胤明）及び寺永慈恵院（寺永法専）であり、北海道集治監における過酷な囚人労働により心身に障害を負った者への救貧的な援助がなされていたことが分かった。大正期に入ると、保護会活動の興隆とともに事業の目的や成績・運営等をめぐって「不具廃疾」者への処遇が課題視されるようになり、彼らの労働能力や就業への意思にかかわって「不具廃疾」者は病院や養育院等へ収容すべきであると主張されるようになった。しかしながら、救護施設への委託は拒絶される状況にあり、心身に障害のある免囚者への保護は進展しなかったことが明らかとなった。「不具廃疾」の刑余者の保護をめぐる考え方の変遷に関し、①保護事業における「救貧」から「更生」への役割純化、②被保護者の労働能力及び就業意思の重視、③明治～大正期にかけての「良民」概念の拡大の３点を指摘した。

The protection and construction committee refuses to apply for emergency treatment, mental and physical protection and protection for those who do not need to be exempted from prison. Those who do not have a disease are responsible for the protection of the disease, the protection of the health care industry, the salvation of the health care industry, the rehabilitation of the injured, the ability of the insured to pay attention to the concept of "good people" during the Meiji ~ Dazhong period.
