昨年度に引き続き、研究課題に関わる国内外の文献資料を収集した。政党国家を論じたものはもとより、党内民主主義と法的規律の関係を考察したものも、とりわけドイツには豊富な理論的蓄積があり、多くの文献を集めることができた。その際、大学院生をアルバイトとして雇い(資料の収集・コピーおよび整理)、科学研究費より謝礼を支出した。そのうえで、今年度はとくに、政党内民主主義の憲法上の位置づけについて、日本とドイツの議論の比較検討を進めた。日本では従来、政党の「国家からの自由」を強調して、党内民主主義を法定することに懐疑的な見解が主流であったが、近年、政党に対する法的規律を、内部秩序へのそれをも含めて積極的に要請する見解が増えつつある。とはいえ、何故に「私的結社」である政党に、内的民主性が要請されるかは、ほとんど議論されておらず、憲法の政党条項に基づいて党内民主主義を法定しているにもかかわらず、その原理的基礎を究明するドイツと好対照をなしている。ドイツの議論は、政党を民主制に不可欠の媒体と見る「政党国家」論に基づくものや、民主主義を国家の領域のみならず社会的秩序にも要請する「社会=民主主義」論に基づくものなどに分類できるが、いずれもヴァイマル民主制の「悲劇」を引証している点に特徴がある。なお、こうした問題も含めて、ドイツの政党国家論と憲法との関わりを総合的に検討した著作につき、とりわけ日独両国の理論の比較可能性に着目して書評をまとめ公表した(裏面「研究発表」欄、参照)。それをもとに、上記のようなドイツの議論を、日本の党内民主主義論にどのように摂取できるかを検討するのが、今後の課題である。
