本研究費受給の成果は、本年度公表した論文にその一部が生かされているが(「研究発表」欄記載の拙稿、参照)、当該研究課題を全面的に検討する論稿を現在執筆中である。「研究計画調書」にそって現段階の状況を示せば、以下の通り。まず、ドイツ「政党国家」論の史的展開の特徴がほぼ明らかとなった。すなわち、ヴァイマル期においては、政党を議会制の阻害物とみる近代的民主政観と、政党制の事実上の展開を規範のレベルまで高めようとする現代的民主政観とが対抗していたが、「第三帝国」による民主制の崩壊を経て、その原因を政党の憲法上の位置づけの曖昧さに見出したボン基本法は周知の政党条項を導入し、学説上も、一定の枠内の政党の活動を憲法上積極的に規律することで民主性の復興をはかろうとする、かなり厳格な「政党国家」論が主流をしめるにいたった。しかしその後、このように憲法で保護されたドイツ政党制が「安定的展開」を回復するにともなって、政党制が次第に市民から遊離していくという「政党国家の病理」が指摘されるようになったのである。つぎに、近時の「政党・政治への倦怠」が蔓延するなかで何が問題とされているかを、研究費により購入した文献に基づき整理した。端的には政治スキャンダル、国庫のお手盛り的利用などであるが、より構造的には、一方での政党の政治権力への執着と他方での政治指導力の欠如、さらには「国民政党」化による国民統合能力の減退などが挙げられている。今後は、これら問題点に対する憲法学の理論的対応につき引き続き整理・検討を進めて、上記のような従来の「政党国家」論との連関を、現代議会制民主主義の危機とその克服という歴史的な文脈のなかで検証していきたい。
