本研究課題は、地球環境保護のための通商制限措置の利用とGATT/WTO体制により確立され自由貿易原則の法的調整について、北米自由貿易協定(NAFTA)にそのモデルを求めることの可能性を探るものである。NAFTA104条は、域内における通商自由化に関する協定の基本的な義務に対して、各国の措置が最もNAFTA適合性の高いものを選択する限りにおいて、多国間環境協定(MEAs)に規定される環境保護目的の通商規制の国内的実施義務を優先する。このような規定はきわめて画期的な試みではあるが、比較的これに近い文言と趣旨のGATT20条bにおける先例を参照するかぎり、これを満たす措置の範囲は極めて限られており、将来具体的に紛争が起きた際にMEAs上の義務の履行が制限されることが学説レベルでは懸念される。これまでのところMEAsの国内的実施が問題となる紛争事例はなく、NAFTA104条の解釈は明らかになっていない。その一因としては、現状では各国が比較的MEAsに規定に適合した国内実施法を整備したことが挙げられる。とりわけ北米大陸において問題が顕在化してきた廃棄物取引の分野では、NAFTA締結以前からバーゼル条約の規制レベルを越えない範囲での米加・米墨廃棄物協定が締結されており、二国間協力が進んでいることも見逃せない。その一方で、これと類似したモデルはWTO「貿易と環境」委員会においても提示されており、その有効性が実務・学界双方から期待されている。NAFTAの場合は米国を中心として、あくまでも政治的同質性を前提とした米加関係、および経済的相互依存を重視した米墨関係が前提となっていることに留意し、その限界を見極めつつGATT/WTO体制の下での多国間関係への応用可能性を模索する努力が今後必要となる。そのためにもNAFTAでの今後の慣行の蓄積が注目される。
