昨今、地球レベルでの環境保護政策を策定する多国間環境条約(MEA)が締結されるが、これらの一部が政策手段として多用する通商制限が、GATT/WTOに代表される国際的な自由貿易規範と法的緊張関係にある。モントリオール議定書(オゾン層保護)に代表されるMEAにおける通商制限は、条約加盟国拡大を意図して非加盟国にのみ差別的に適用されたり、製品としてはでなくその製造工程が有害な物質を規制するなど、間接的に環境上の政策目標を達成するために用いられる。この点は、それ以前の環境保護目的の通商制限が、専ら環境価値財/有害物質の国際移動の規制により直接的に政策目標に達成したのとは大きく異なる。また、従来の通商制限は専ら制限実施国領域内の環境保護のために適用されるが、グローバルな存在を保護対象とするMEAにおいては、通商制限による保護対象は必ずしも領域内にあるとは限らない。一方、無差別かつ自由な貿易の実現を標榜するGATT/WTOは、一律に通商制限を禁じている。また、最恵国待遇、内国民待遇の供与に際して、最終製品として同種であるものの平等な取り扱いを既定している。とすれば、上記MEAの通商規定はGATT/WTOに抵触することは否めない。もっともGATT20条は、人体・動植物の保護に必要かあるいは有限天然資源の保存に関する通商制限を、例外として認めている。しかるにこれまでの紛争事案において同条項は非常に狭く解釈されており、MEA上の通常措置の包括的な例外化に資するものではない。96年の米ガソリン精製基準に関するWTO上級委員会報告は、若干環境に配慮した柔軟な20条の解釈を提示した点で注目されるが、MEAとGATT/WTOの矛盾を解消するには至っていない。現行法の解釈による解決に限界が見られる現在、NAFTAにおける前例などを参照しつつ、立法的解決によって「持続可能な社会」における通商法の在り方を模索することが望まれる。

The conclusion of multilateral environmental treaties (MEAs) on environmental protection policy in the world today represents the tension between international free trade norms and laws represented by GATT/WTO and a number of policy instruments and trade restrictions. The MEAs represent trade restrictions, treaty member states, and non-member states. The MEAs also represent differences in application, product, and production engineering. The MEAs also represent environmental policy objectives. This point is different from the previous environmental protection objectives of trade restrictions, environmental protection/regulation of international movement of hazardous substances, and direct policy objectives. Environmental protection within the territory of the United States shall be subject to the protection of the environment within the territory of the United States. The 1996 report of the WTO High Committee on the improvement of standards for environmental protection provides 20 points of concern for the resolution of conflicts between MEA and GATT/WTO. The solution of the existing law is limited by the present situation, the precedent of NAFTA, the solution of legislation, the solution of "possible society" and the solution of trade law.
