项目摘要

フランス不法行為法における賠償範囲に関する判例学説の全体像の解明にはなお一層の検討を要するが、基本的には次の点が指摘できる。(1)事実問題としての因果関係と法的問題としての賠償範囲という二分法は判例学説とも採用していない。規範的要件としての「因果関係」の判断を原因・結果の連鎖関係に照らして行い、「必然性」のあるものとして説明できるかを重視する傾向にある。(2)経済的な波及損害については「損害の確実性」で判断する傾向にある。(3)以上とは別に損害が正当な利益の侵害によるものかも問題とされることがある。一方、日本の不法行為における相当因果関係に関する判例・下級審裁判例は、全体的には民法416条の類推適用によらない傾向が強く、特にハードケースでは、原因・結果の連鎖に着目するものが少なくない。損害の確実性・必要性や、法的保護に値する利益の侵害の有無が問題とされている点も、フランスと類似する。本研究の帰結はこうである。日本と同じく統一的不法行為要件をとるフランスではフォート(過失)の射程という考え方は否定されていること、日本の裁判例における過失・違法性判断は行為不法的なものも多いことから、義務射程説は支持できない。相当因果関係は、原因・結果の連鎖の必然性に照らし加害者の行為に帰責しうるか否かの判断として整理し直すべきであり、判例が民法416条2項を類推適用する主な場面である転売利益等の逸失利益の問題は、損害の確実性という形で損害の要件に引き付けて整理し直すべきである。相当因果関係の問題とされてきた、被害者による支出の相当性についても、損害の必要性という形で損害の要件に引き付けて整理し直すべきである。法的保護に値する利益の侵害による損害か否かは、従来の最高裁判例ではもっぱら精神的損害について問題とされてきたが、今後は財産的損害についても一つの要件として活用されるべきである。
