本研究は、明治憲法制定過程においてわが国で盛んに受容されたドイツ法学の実態を、文化交渉史という視点から、法制史、政治史、社会史の観点をも交えて解明することを課題とした。明治14年の政変を機に「英仏学の暗消」を掲げて導入されたドイツ法学=「独逸学」は、明治政府の統治を支える知的支柱だった。本研究は、まず従来の独逸学受容を巡る学説状況の確認と最近相次いで出された関連研究の批判的検討を行い、平成13年9月にはドイツとオーストリアにおいて、独逸学の担い手だった当時のお雇い法律家に関する根本史料を調査した。これまで独逸学継受の場としては、専ら明治14年設立の独逸学協会(後、独逸学協会学校)ばかりが脚光を浴びてきた。これに対して、本研究では上記のような基礎史料の収集とそれらの検討、特に帝国大学初代政治学教授カール・ラートゲンの滞日時の母国宛書簡集とウィーン大学国家学教授ローレンツ・フォン・シュタインの陸奥宗光宛個人講義の筆記録という未知の史料の考察を通じて、明治20年創設の国家学会の重要性に着目し、通説の見落としてきた同学会と前記独逸学協会の学理的政治機能的断絶面に着目するに至った。伊藤博文の立憲指導者としての自立に伴い彼の肝いりで創られた国家学会においてはじめて、「独逸学」は明治立憲体制を支える知的複合体として確立したといえる。その理論的特色として指摘できるのは、来るべき憲法秩序を固定したものとして捉えるのではなく、後代の社会の発展に応じた伸縮可能性を備えた制度設計を明治政府の指導者に開眼させたという構想知の側面、そして立憲体制の外部的保障としての行政システムへの人的・理論的資源の供給という知の装置としての側面である。そのような「独逸学」は、進化論的制度知と名付けうるものと考えられる。

This study focuses on the collection of basic historical materials and the importance of establishing the National Society in the 20th year of Meiji. The political function of the Association for the Study of Foreign Language and Literature is closely related to the academic function of the Association. Ito Hirobumi's constitutional guidance and self-reliance are accompanied by the creation of the National Society and the establishment of the Meiji constitutional system. The characteristics of the theory are: the constitutional order is fixed, the social development of the future generation is flexible, the possibility of system design is open, the guidance of the Meiji government is open, the bottom of the assumption is known, the external guarantee of the constitutional system is known, the human resources are supplied, the device is known, the bottom of the theory is known. The theory of evolution is based on the theory of "independent learning."
