项目摘要

フランス民事法学研究上,重要と思われる「基礎用語」を,その類語を通して考察してきた。本研究は平成3年度科学研究費補助金の崩芽的研究で試みた研究を,さらに深化し,対象領域を広めた。類似する言葉の異同,法典等にみられる実例,教科書等で示された定義を基礎に分析し,それに加えてフランス人の法学関係者に,それぞれの語感の相異について助言をいただいた。平成3年度の研究目的で示したのと同じように言葉を表現のコンテクストの中で理解しうるように心がけ又この言葉を実際に用いることが,できるよう注意点を示した。本年度は,さらに表現を超え実生活や社会のコンテクストでの解説も加えた。このようにして完成した原稿を法律雑誌に連載し,順次公表している。本年度は,法律家の問題の中で弁護士と公証人を公表している。本年度の研究は,契約に関連する用語の範囲を広め,書面による証拠を重視するフランス法に注意をはらい,いかに契約上書かれた言葉が重要であるか,また実際にどのような言葉が重要であるかについて,言葉の用い方とならんで明らかにした。その他,裁判外での紛争解決方法,合意の解消に関しては,用語のレベルでの研究を終了した。これらのテーマについて,さらに実生活上,社会のコンテクストの中での分析を加える作業が残っている。原稿完成後順次連載の中で公表する予定である。
