改正民法の法的家族像は欧米の近代家族である。民法750条は「婚姻の際に定めるところに従い、夫または妻の氏を称する」とし、夫婦に平等を保障しているようにみえる。しかし、結果的には、長期にわたって、98%の女性が夫の姓を称してきたのである。私たちが行った夫婦別姓に関する調査(東京都女性財団助成)でも、夫の姓を名乗る女性は夫の意向と社会の慣習を主たる理由として夫の姓になっていた。750条の条文は氏姓について夫婦の平等を制度的に保障しているにもかかわらず、実際には有名無実化している。その出発点に関心を持った。民法制定にたずさわった学者や法務省の担当官らは当初からそうなることを見越していた。一方法制局(LS)局長オプラーは「個人主義にもとづく家族の問題が注意深くとり扱われるべき」と考え、進歩派の勝利に勇気づけられたという。改正民法の制定過程で夫と妻の平等をめざしながら、そこに男性優位性を保障してしまう(制度的)メカニズムを明らかにすることが本研究の目的であった。民法改正に携った人々とLSの担当官との意識や認識のギャップ、民法改正にたずさわった人々の中での進歩派と保守派の勢力関係やオプラーらの見解をどう受け止めたかなどがメカニズムの中核を担っていることは間違いない。それを明らかにするために、民法制定過程にかかわった人々の家族観、夫婦観、男女平等観をさぐることとしたが、平成6年度は資料収集に終始する結果となった。それらは、衆参両院議会本会議・各種委員会の議事録、我妻栄、中川美之助、川島武宣、来栖三郎らの著書・論文、GHQ/LSやGS(民政局)のオプラー、ブレイクモアらのGHQ文書、および関連論文等、世論調査研究所や時事通信社の世論調査などである。
