一八七一(明治四)年に近世以来の「賤民制」が廃止され、賤民は法と制度からは解放されたが、その旧賤民を<賤視差別>するイデオロギーとその習俗的遺制は、国の政策や社会的諸関係のなかで温存され、明治二〇年代における地方自治制が成立する過程で、社会構造に位置づけられ、近代における部落問題が成立した。そして資本主義の確立する日清戦争後、部落問題は社会問題として顕在化し、近代における部落問題は明治三〇年代において、初めて本格的に文学の素材としてとりあげられることになった。すなわち明治三〇年代の文学状況のなかで、模索された様々な文学的可能性がその主題の一つとして部落問題をとりあげたのである。悲惨小説における部落問題は、部落民が社会的に顕在化する中で、殊更に<おぞましい異類>としてその異常さを強調するものであったが、一部の批評家によって先導され文壇に登場したのである。そして悲惨小説の背徳性の反措定として登場した家庭小説は、日常生活の中に初めて部落民を登場させ、それが一定のパターン化しながら、破滅しない部落民を描くことになった。またキリスト教の部落伝道を描いた作品も散見されるが、総じて明治三〇年代において文学の主題としてとりあげられた状況が、やがて島崎藤村の「破戒」に結実することになった。「破戒」における部落民は、<血の穢れ>という負性において捉えている同様の限界はあるが、それまでの眺められる部落民ではなく、部落民自らがその素性に煩悶する個性として、藤村自身の文学的渇望が創造したものである。このように藤村自身の感性を通わせた文学的営為によって、明治三〇年代の部落民をとりあげた数多くの小説を越えた「破戒」一篇の価値が生み出されたものである。しかし内面的な煩悶が、その告白によって未熟な社会的形象をしか結ぶことができなかったことに、部落問題をとりあげた「破戒」の時代的な制約が存するのである。
